Ganv Terms & Conditions
Ganv Group LLC, an international company duly incorporated under the laws of Dubai, United Arab Emirates, provides air, sea, road, cross-border, and inland waterway transport services.
As part of our innovation-driven vision, Ganv operates under a 100% digital model through our exclusive platform MyGanv.
MyGanv centralizes all processes related to your shipments: booking, issuance of electronic documents, real-time tracking, claims management, and automatic updates of contractual conditions.
These Conditions of Carriage define the rules applicable to our services, set out your rights and obligations as a customer, and establish the legal framework of our responsibilities. Their purpose is to ensure a transparent, secure, and internationally compliant relationship.
1.Ganv Electronic Transport Documents
1.1 Nature of documents
Ganv issues only secure digital transport documents, legally equivalent to traditional paper forms:
- e-BL (Electronic Bill of Lading) for maritime transport,
- e-AWB (Electronic Air Waybill) for air transport,
- e-CMR (Electronic Road Consignment Note) for road transport,
- Electronic documents for inland waterway and cross-border transport.
1.2 Security and traceability
- Each document has a unique identifier, time-stamped and certified via MyGanv.
- Data is protected by encryption, multi-factor authentication, and full traceability.
- Digital copies remain accessible at all times to prove authenticity in case of dispute.
1.3 Legal force
- These digital documents carry the same legal validity as paper documents, in compliance with international conventions (e.g., Rotterdam Rules, IATA e-Freight, e-CMR).
- In case of language discrepancies, the English version shall prevail.
2.Ganv Electronic Transport Documents
Ganv applies the following conventions depending on the mode of transport:
- Air: Montreal Convention (1999),
- Road: CMR Convention,
- Maritime and inland waterways: Hague-Visby Rules, Hamburg Rules, or Rotterdam Rules (if applicable),
- Multimodal digital: UAE law and applicable international conventions.
Documents issued through MyGanv constitute legally binding contracts between the customer and Ganv.
3.Customer Obligations
The customer undertakes to:
- Provide accurate and complete information via MyGanv (nature, weight, value, volume, potential hazards).
- Declare any sensitive or regulated cargo (dangerous goods, perishables, pharmaceuticals, high-value shipments, or items subject to customs control).
- Comply with all local, international, and customs regulations.
- Ensure that a cargo insurance policy covering the full value of the goods is in place.
Any false declaration, omission, or non-compliance may result in:
- Refusal of carriage,
- Suspension of transport,
- Liability for losses, fines, or damages incurred.
4.Responsibilities and Limitations
Ganv assumes liability strictly in accordance with the limits defined by the relevant conventions:
- Air transport: 22 Special Drawing Rights (SDR) per kilogram (Montreal Convention),
- Maritime/inland waterway transport: 666.67 SDR per package or 2 SDR per kilogram (Hague-Visby Rules),
- Road transport (CMR): 8.33 SDR per kilogram,
- Multimodal transport: applicable rules for each segment.
Ganv shall not be held liable beyond these limits, except in cases of gross negligence or willful misconduct.
5.Claims Deadlines and Procedures
5.1 Deadlines
Claims must be filed through MyGanv within the following time limits:
- Air transport: 14 days after delivery,
- Maritime/inland waterway transport: 7 days after delivery,
- Road transport (CMR): 7 days after delivery.
5.2 Procedure
- Claims must be supported by evidence (photos, invoices, damage reports).
- MyGanv generates a digital case reference number, allowing transparent tracking of the claim process.
- All communications regarding claims are processed exclusively through MyGanv.
Claims submitted after these deadlines shall not be admissible, unless otherwise required by law.
6. Compliance and Digital Security
6.1 Regulatory compliance
Ganv ensures compliance with international and local standards:
- Maritime/inland waterway: ISPS Code, SOLAS,
- Air: ICAO, IATA,
- Road: CMR and bilateral agreements,
- Multimodal: international trade rules, sanctions, embargoes, and export controls.
6.2 Digital security
- Ganv applies international cybersecurity standards: ISO/IEC 27001 certification, SSL encryption, and regular audits.
- All customer data and transactions are securely stored and fully traceable.
- In case of a cyber incident, a dedicated notification protocol is activated via MyGanv.
7. Governing Law and Jurisdiction
These Conditions of Carriage are governed by the laws of Dubai and the United Arab Emirates, supplemented by applicable international conventions depending on the mode of transport.
All disputes shall fall under the exclusive jurisdiction of the courts of Dubai, unless otherwise mandated by international conventions.8. Amendments
Ganv reserves the right to amend these Conditions of Carriage at any time.
- Updates are published directly on MyGanv and take immediate effect.
- Each customer is automatically notified of updates through their digital account.
